Terms of Use

These terms govern your use of PGStack. Please read them carefully before using the platform. By creating an account or making a booking, you accept these terms.

1. Acceptance of Terms

By accessing or using PGStack (pgstack.co.in), you agree to these Terms of Use. If you do not agree, do not use the platform. These terms apply to all users — seekers, PG owners, operators, agents, and administrators.

2. Eligibility

You must be at least 18 years old to use PGStack. By creating an account, you confirm that you are 18 or older and that the information you provide is accurate.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account • You must not share your OTP or session with anyone • You must notify us immediately of any unauthorised access • We reserve the right to suspend or terminate accounts that violate these terms

4. PG Owner Responsibilities

Owners who list properties on PGStack agree to: • Provide accurate, up-to-date information about their property • Not list properties they do not own or have the right to rent • Respond to booking requests within 24 hours • Not engage in discriminatory practices (caste, religion, gender beyond stated PG type) • Honor confirmed bookings or notify seekers promptly if unable to • Comply with all applicable local laws for PG accommodation • Maintain the physical safety and security of the property and its residents • Conduct police verification of tenants as required by local law • Report any theft, crime, or safety incident to local police — PGStack is not a substitute for law enforcement • Bear sole and full responsibility for all incidents, theft, damage, or harm occurring at their property • Maintain adequate security measures (functional locks, lighting, etc.) at all times • Maintain all amenities listed on the platform in working condition (WiFi, AC, geyser, lift, power backup, etc.) • Ensure regular housekeeping, room cleaning, and common area maintenance as described in the listing • Address maintenance requests from tenants promptly — PGStack is not responsible for any maintenance, repair, or upkeep of the property

5. Seeker Responsibilities

Seekers using PGStack agree to: • Provide accurate personal information • Not make fraudulent or speculative booking requests • Contact owners only through the platform or contact details provided on the listing • Not harass, threaten, or abuse owners or platform staff • Honor confirmed bookings or cancel in advance

6. Prohibited Activities

You must not: • Scrape, crawl, or harvest data from PGStack • Attempt to reverse-engineer, hack, or disrupt the platform • Use automated systems to create fake accounts or listings • Post false, misleading, or defamatory content • Use PGStack for any unlawful purpose • Interfere with other users' use of the platform

7. Platform Role

PGStack is a marketplace — we connect seekers with owners. We do not own, manage, or control any PG properties. We are not a party to any rental agreement between seekers and owners. We do not guarantee the accuracy of listings or the conduct of any user.

7A. Safety, Theft & Physical Incidents

PGStack is an online listing platform only. We are not responsible for, and expressly disclaim all liability in connection with: • Theft, burglary, robbery, or loss of personal belongings at any PG property listed on PGStack • Physical assault, harassment, injury, or harm of any kind occurring at or near a listed property • Fire, flood, structural damage, or any damage to property or personal belongings • Conduct, negligence, or criminal acts of any owner, tenant, operator, agent, or third party • The adequacy of security arrangements at any property (CCTV, locks, guards, etc.) • Any incident arising from the condition of the property, whether disclosed or undisclosed By using PGStack to discover or book a PG accommodation, you acknowledge and agree that: • PGStack has not inspected, verified, or warranted the physical security of any listed property • It is your sole responsibility to assess the safety of a property before moving in • You should conduct your own due diligence, including visiting the property in person • PGStack strongly recommends not leaving valuables unattended in any accommodation Owners and operators who list properties on PGStack bear full and sole responsibility for the physical safety, security, and condition of their properties and the wellbeing of residents.

7B. Property Maintenance & Amenities

PGStack is a listing and discovery platform. We are not responsible for, and expressly disclaim all liability in connection with: • The maintenance, repair, or upkeep of any PG property listed on PGStack • Non-functioning or broken amenities including lift, elevator, AC, geyser, WiFi, power backup, CCTV, or any other facility advertised in a listing • Room cleaning, housekeeping, laundry, or any other services described in a listing • Water supply, electricity supply, or utility failures at any property • Pest control, sanitation, or hygiene conditions at any property • Common area maintenance including corridors, staircases, parking, or shared bathrooms • Any discrepancy between amenities listed on PGStack and amenities actually available at the property Listing information is provided by property owners and is not independently verified by PGStack for ongoing accuracy. Amenities that were present at the time of listing may change without notice — PGStack is not responsible for such changes. If amenities described in a listing are not available, your recourse is directly with the property owner. PGStack may assist in dispute resolution as a courtesy but is not obligated to do so and bears no financial liability for amenity shortfalls.

7D. Illegal Activities by Users

PGStack is a passive technology intermediary under the Information Technology Act, 2000 (Section 79). We are not responsible for, and expressly disclaim all liability in connection with, any illegal, unlawful, or criminal activity carried out by any owner, seeker, tenant, operator, agent, or third party using this platform. This includes but is not limited to: • Running an unauthorised or unlicensed PG accommodation • Operating a property for illegal purposes (drug activity, prostitution, gambling, trafficking, or any other unlawful trade) • Illegal subletting, trespassing, or property fraud • Tax evasion, GST fraud, or misrepresentation to authorities • Identity fraud, impersonation, or use of forged documents during registration • Harassment, stalking, assault, or any criminal act against another user • Possession or use of illegal substances, weapons, or contraband at a listed property • Violation of local laws, municipal bylaws, or police regulations applicable to PG accommodation • Any act constituting an offence under the Indian Penal Code / Bharatiya Nyaya Sanhita, POCSO, or any other applicable statute PGStack's safe harbour under IT Act Section 79: PGStack qualifies as an intermediary under the Information Technology Act, 2000. We are not liable for third-party content or conduct provided that: • We do not initiate, select, or modify the unlawful content or transaction • We act expeditiously to remove content upon receiving actual knowledge or a valid government/court order User obligation to report: If you become aware of any illegal activity occurring through or in connection with PGStack, you must report it immediately to the relevant law enforcement authorities. You may also notify us at legal@pgstack.co.in — we will cooperate fully with law enforcement investigations. PGStack does not shield users from legal consequences. We will share user data (name, phone, IP address, device details, activity logs) with law enforcement agencies upon receipt of a valid legal order, without notice to the user.

7C. No Background Check Warranty

PGStack does not conduct criminal background checks on owners, tenants, agents, or operators. Verified badges indicate identity or document verification only — they do not constitute a character reference, safety endorsement, or guarantee of conduct. PGStack Verified status means: • The user's phone number has been verified via OTP, and/or • The user's identity document (Aadhaar/PAN) has been verified It does NOT mean: • The user has no criminal record • The property is free from risk • PGStack vouches for the user's character or behaviour You use this platform and interact with other users at your own risk.

8. Payments

PGStack does not collect rent or security deposits. All payments are made directly between seeker and owner. PGStack's platform fee (if applicable) is charged separately and disclosed at the time of transaction.

9. Intellectual Property

All content on PGStack — including the name, logo, design, and code — is the property of PGStack. User-generated content (property photos, descriptions) remains the property of the user, but you grant PGStack a non-exclusive licence to display it on the platform.

10. Limitation of Liability

To the maximum extent permitted by law, PGStack is not liable for: • Any loss arising from reliance on listing information • Theft, loss, or damage to personal property at any listed accommodation • Physical harm, assault, injury, or safety incidents at or near a listed property • Disputes between seekers and owners • The conduct, acts, or omissions of any owner, tenant, operator, or agent • Loss of data or service interruptions • Indirect, consequential, special, incidental, or punitive damages • Any criminal or civil acts by any user of the platform • Any illegal activity, fraud, or unlawful conduct by any owner, seeker, operator, or agent • Any loss arising from fake, fraudulent, or misrepresented listings created by third parties • Regulatory penalties, police action, or legal proceedings initiated against any user PGStack provides a technology platform only. We are not a property manager, landlord, rental agency, safety authority, or law enforcement agency. All interactions between seekers and owners are at the sole risk of those parties. PGStack is not a party to any transaction, rental agreement, or arrangement between users. Our maximum liability for any claim is limited to the amount you paid to PGStack in the 3 months preceding the claim. In no event shall our liability exceed ₹5,000.

11. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

12. Changes to Terms

We may update these terms at any time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.

13. Grievance Officer

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the details of the Grievance Officer are: Name: Grievance Officer Email: grievance@pgstack.co.in Organisation: PGStack, Hyderabad, Telangana, India Complaints must be acknowledged within 24 hours and resolved within 15 days of receipt.
